Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Blue Dot mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement. If you are between 13 and 18, you must have parental or guardian consent.

3. Account

3.1 Account Creation

You may use certain features of the App without an account. To access social features and cloud sync, you must sign in using Apple Sign In. You are responsible for maintaining the security of your account.

3.2 Account Termination

You may delete your account at any time through the App's Settings. We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

4.1 Your Content

You retain ownership of all content you create in the App, including trip data, photos, videos, notes, and profile information (“User Content”). By using the App, you grant us a limited license to store, process, and display your User Content as necessary to provide the App's features.

4.2 Shared Content

When you share trips with other users (via trip tags, invite links, or public profile), you grant those users permission to view the shared content. You control what is shared through the App's sharing settings.

4.3 Content Standards

You agree not to upload or share content that:

  • Is unlawful, harmful, threatening, abusive, or harassing
  • Infringes on intellectual property rights of others
  • Contains malware or harmful code
  • Impersonates another person or entity

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the App's functionality
  • Scrape, crawl, or harvest data from the App
  • Use the App to spam or harass other users
  • Create multiple accounts to circumvent blocks or restrictions

6. In-App Purchases

6.1 Passport Pro

The App may offer premium features through in-app purchases (“Passport Pro”). All purchases are processed by Apple through the App Store and are subject to Apple's terms and conditions.

6.2 Refunds

Refund requests for in-app purchases must be directed to Apple, as they handle all payment processing.

7. Intellectual Property

The App, including its design, code, graphics, and branding (excluding User Content), is owned by Blue Dot and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

9. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure.

Travel information displayed in the App (country data, statistics, maps) is for informational purposes only and should not be relied upon for travel planning or safety decisions.

10. Limitation of Liability

To the maximum extent permitted by law, Blue Dot shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or personal injury.

Our total liability shall not exceed the amount you paid for the App or in-app purchases in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Blue Dot from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify you of material changes through the App.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
